The Supreme Court said, the Ministry of Defense cannot issue instructions regarding the payment of installments of One Rank Pension (OROP) arrears. Such a tax ministry cannot take the law into its own hands. The main court has asked the Ministry of Defense to provide a road map by March 20 for the payment of debts.

A bench of CJI Justice DY Chandrachud, Justice PS Narasimha and Justice JB Pardiwala ordered the ministry to immediately withdraw its January 20 communication. In this regard, the ministry had mentioned paying the remaining amount of OROP in four installments. Attorney General R Venkataramani said the Center has paid one installment of OROP payments to ex-servicemen, but it needs more time to make the next payment.

“First, withdraw your January 20 notification on payment of OROP dues, then we will consider your request for more time,” the bench told Venkataramani. The Ministry of Defense’s January 20 circular is completely against our decision, the bench said. The Ministry, on its part, cannot unilaterally say that it will clear the OROP dues in four installments. The bench asked the Attorney General to prepare a road map within a week specifying the amount to be paid, the methods to be adopted and the priority for payment of debts.
