Umesh Pal, who was murdered in Prayagraj on 24 February 2023, was dropped from the witness list by the Central Bureau of Investigation (CBI) in the Raju Pal murder case in 2005. It is alleged that the murder of Umesh Pal, a lawyer by profession, was on the former -The jailed Member of Parliament Atiq Ahmed and his associates. These people are also accused of killing BSP MLA Rajupal. The UP police had said that Umesh Pal was killed because he was an important witness to Rajupal’s murder. But Rajupal’s wife says Umesh Pal later retracted his statements. In this way, the story of Umesh Pal’s murder and this whole issue has reached a strange situation. The Indian Express has published a report in this regard today, March 15.

According to Indian Express, CBI is the third agency after Prayagraj Police and CB-CID to investigate the murder of BSP MLA Raju Pal. The case is currently being held in the special CBI court in Lucknow. Atiq Ahmed and his brother Ashraf are also prime accused in the 2005 murder case.

A CBI official said that 48-year-old Umesh Pal has been listed as a witness by the UP police during their investigation into the Raju Pal murder case. But when the CBI took over the investigation in 2016, the CBI found him “unreliable” and did not list him as a prosecution witness.
A CBI official said – CBI did not make Umesh Pal a witness in the Raju Pal murder case because the investigating agency did not find him credible.

Following the murder of Raju Pal and two of his teammates in Prayagraj on January 25, 2005, the police had registered an FIR against Atiq Ahmed and his brother Ashraf on the complaint of Pooja Pal. Pooja and Rajupal were married just nine days before Rajupal’s murder. Pooja had named Atiq, Ashraf and seven unknown people in her complaint.

On April 6, 2005, the Prayagraj police filed a chargesheet against 10 people, including Atiq and Ashraf, in a local court. In the trial, Umesh Pal was a witness. But he allegedly retracted his statement later.

I moved the Allahabad High Court and later the Supreme Court, demanding a CBI investigation into the murder case as some of the prosecution witnesses had turned hostile and did not support the police theory of Rajupal’s murder. Umesh Pal was also declared as one such hostile witness.

According to Pooja Pal, Umesh Pal claimed that she changed her statement in the court because Atiq and his teammates abducted and threatened her.

In 2007, after the BSP came to power in the state, Umesh Pal had filed a kidnapping case against Atiq. Prayagraj district public prosecutor Gulab Chand Agnihotri told The Indian Express that the trial in that case is currently being held in the Prayagraj court and is in its final stages.

In December 2008, the state government led by then BSP chief Mayawati handed over the investigation into the Rajupal murder case to the Crime Branch (CB-CID) of the UP Police. The CB-CID named seven other persons as accused in its charge sheet.

In 2014, after almost six years, the Allahabad High Court rejected Puja Pal’s plea seeking a CBI probe into her husband’s murder. After this he went to the Supreme Court for a CBI investigation.
The Supreme Court ordered a CBI investigation and on January 22, 2016, the investigation was handed over to the CBI. In August 2019, the CBI filed a chargesheet against 10 people, including Atiq Ahmed and Ashraf.

A senior lawyer associated with the Raju Pal murder case said that the CBI has not mentioned the names of witnesses in its charge sheet and case diary. “It appears from the chargesheet that Umesh Pal was not made a witness by the CBI. I have also come to know myself that he was not made a witness.

The Prayagraj police had registered a case against Atiq Ahmed, his wife Shaista Parveen, brother Ashraf, his two sons and two others following the murder of Umesh Pal on February 24 this year.

According to the Indian Express, the police said that prima facie it appears that Umesh Pal was killed by Atiq Ahmed’s associates and his family members to intimidate witnesses. However, a senior police officer involved in the investigation said:

We are yet to ascertain the exact reason behind Umesh Pal’s murder. Many people are being questioned and the investigation is underway. We cannot share the details of the investigation.

So far, the police have claimed to have killed two persons (Arbaaz and Vijay Singh) involved in Umesh Pal’s murder in separate encounters in Prayagraj. The accused named Balli Pandit has been arrested and six accused including Shaista Parveen are absconding. While Atiq is lodged in Gujarat jail, Ashraf is in Bareilly jail.
